Boat Brokering Agreement

Selling Program understands and acknowledges that Finish Line Shell Repair [Broker] is acting as a third-party broker to locate a boat for Buying Program that meets the Buying Programs criteria.

Selling Program has provided Finish Line Shell Repair with an accurate description and photographs of a boat[s] for purchase. Any damages have been disclosed.

Finish Line Shell Repair reserves the right to void this Agreement if the information provided by Selling Program is not true and correct as warranted herein.

If the Selling Program in this Agreement and the Buying Program circumvents or goes around the Broker in an attempt to avoid payment of the commission or fees to the Broker, the Buying Programs purchase will be treated as a sale and the 30% of sale price will be due and payable to the Broker.

This contract is good for 90 days.

Finish Line Shell Repair agrees to pay Selling Program within 30 days of receiving payment from the buying team. Amount to be agreed upon in writing before sale.

Finish Line Shell Repair is not responsible for maintenance and/or repair of the boat[s] sold by Selling Program and makes no warranties (and in fact disclaims all warranties) relating to the condition of any such boat[s]. Buying Program is solely responsible for performing any and all due diligence it feels is necessary prior to purchasing any boat[s].
Selling Program specifically agrees that it is providing accurate and all information available regarding the condition, history, reliability, or other details to Finish Line Shell Repair and buyer.

The Selling Program hereby promises to defend, indemnify, and hold harmless Finish Line Shell Repair, it’s employees, agents and affiliates from any and demands, judgements, claims, including reasonable legal and all other expenses, actually incurred and paid, incident to any claim whether baseless or well founded by any third party in connection with the boat sold by Selling Program, including without limitation any claim for taxes by any State of the United States, territory or political subdivision thereof. The indemnification language contained in this agreement shall survive the termination of this agreement.

The Buying Program understands and acknowledges that Finish Line Shell Repair [Broker] is acting as a third-party broker to locate a boat for Buying Program that meets the Buying Programs criteria.

Selling Program has provided Finish Line Shell Repair with a description and photographs of a boat[s] for purchase. This information has been passed to the Buying Program.

Finish Line Shell Repair is not responsible for the pictures or descriptions of the boat.

Finish Line Shell Repair is not responsible for any damage or condition that has not been provided.

If the Selling Program in this Agreement and the Buying Program circumvents or goes around the Broker in an attempt to avoid payment of the commission or fees to the Broker, the Buying Programs purchase will be treated as a sale and the 30% of sale price will be due and payable to the Broker.

This contract is good for 90 days.

The buying program agrees to pay the agreed upon purchase price within 15 days of receiving the invoice.
Failure to do so will result in a $100/day penalty.

Finish Line Shell Repair is not responsible for maintenance and/or repair of the boat[s] purchased by Buying Program and makes no warranties (and in fact disclaims all warranties) relating to the condition of any such boat[s].

Buying Program is solely responsible for performing any and all due diligence it feels is necessary prior to purchasing any boat[s]. Client specifically agrees that it is not relying on any information regarding the condition, history, reliability, or other statements regarding the boat[s] provided to it by the Broker, whether such information was provided verbally or in writing.

Buying Program hereby promises to defend, indemnify, and hold harmless Finish Line Shell Repair, it’s employees, agents and affiliates from any and demands, judgements, claims, including reasonable legal and all other expenses, actually incurred and paid, incident to any claim whether baseless or well founded by any third party in connection with the boat purchased by the Buying Program, including without limitation any claim for taxes by any State of the United States, territory or political subdivision thereof. The indemnification language contained in this agreement shall survive the termination of this agreement.
